1. Nature of the Services

NoMadWay operates as an online marketplace and booking platform where travelers can search for and book travel-related products, services, and experiences (collectively "Operators"). NoMadWay does not own, run or manage any of the services of the operators. Our role is limited to:

• Maintaining the Platform.
• Facilitating bookings.
• Providing customer support.
• Processing payments on behalf of operators.

2. Eligibility & Accounts

You must be at least 18 years old to create an account and make bookings. If you are under 18, you must have permission from a parent or legal guardian. You agree to:

• Provide accurate and complete information.
• Keep your account information secure.
• Notify us of any unauthorized access.

3. Listings & Booking Availability

Activities details such as descriptions, photos, pricing, availability, inclusions, and policies are provided by the Operators. While we strive for accuracy, activities details may change without notice. In case of a conflict, the Operator's latest information and terms & conditions will prevail.

4. Bookings & Confirmation

Your request for a booking does not always mean immediate confirmation. Some bookings may require Operator approval, availability check, or payment verification. You will receive confirmation via email, SMS, or platform notification. You are responsible for:

• Reviewing confirmation details.
• Ensuring correct date and time.
• Providing correct contact info.

5. Pricing & Payments

Prices shown on the Platform are set by Operators in agreement with NoMadWay and include applicable taxes and service fees. Payment may be collected by NoMadWay or through its payment partner. You are responsible for any additional fees such as foreign transaction fees or currency conversion fees charged by your banking/payment provider. Prices are subject to change but changes won't affect current bookings.

6. Your Responsibilities When Booking Activities

By using NoMadWay, you acknowledge:

• You are responsible for checking if you have the skills/health required for activities.
• You must provide accurate information (No. of people, weight, age etc.).
• You must arrive at the activity location on time as per instructions.

You agree to accept all activity-specific terms and rules decided by the Operator. NoMadWay acts only as an intermediary platform and doesn't set standard activity rules.

7. Cancellation, Rescheduling & Refunds

Cancellation and rescheduling policies vary for each activity and are shown in the activity terms at the time of booking. Refunds, if applicable, will be processed within a reasonable time and may depend on payment provider and operator. Exceptions (extreme conditions e.g. weather, safety causes) will be handled as per the respective policy.

8. Conduct & Prohibited Use

You agree not to:

• Violate any laws or our platform policies.
• Post false, misleading or defamatory reviews.
• Use platform for any unauthorized purpose.

We reserve the right to suspend or terminate accounts for violations.

9. Health, Fitness & Assumption of Risk

Activities shown on NoMadWay involve risk. By participating, you confirm that:

• You are fit for the activity.
• You understand the risks involved.
• You will follow all safety instructions.

NoMadWay does not provide and is not responsible for insurance.

10. Limitation of Liability

To the maximum extent permitted under Indian law, NoMadWay and its affiliates shall not be liable for indirect or consequential damages, loss of profits, data, or goodwill. When liability cannot be excluded, it will be limited to the amount paid for the specific booking.

11. Indemnity

You agree to indemnify and hold NoMadWay harmless from any claims, damages, or expenses arising from your use of the platform, your participation in activities, or violation of rights of any third-party.

12. Intellectual Property

All content on the Platform, including text, images, logos, trade names, and software, is owned by NoMadWay or our licensors. You may not use, copy or distribute without permission.

13. Third-Party Services

Our Platform may include links to third-party services such as payment gateways or external websites. We are not responsible for their content or policies.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any legal actions or disputes related will be subject to the jurisdiction of courts in Bengaluru, Karnataka.

15. Changes to These Terms

We may update these Terms from time to time. Continued use of the Platform after update means you accept the revised Terms.
